GENERAL

In these Terms and Conditions; Umbilico means Umbilico (ABN 57163865969) and You means you, the person acquiring goods and services from Umbilico.

These Terms and Conditions can be amended by Umbilico at any time. Reasonable effort will be made to inform clients of changes. Notification of changes will be made via email, published on our website, social media and in studio signage and announcements.

Acceptance of Terms and Conditions is a condition of entry. Continued use of the services and/or payment of membership/pass fees is deemed to be acceptance of these Terms and Conditions.

Umbilico complies with the Privacy Act. We take the protection of your personal information seriously. If you have any questions about our Privacy Policy, or if you wish to request access to your personal information, correct or update your details or raise any privacy concerns you may have, please contact us at enquiries@umbilico.com.au.

The information that you provide to us is stored by our client management software system Mindbody Online. Their Privacy Policy can be viewed here.

TERMS & CONDITIONS

In voluntarily attending classes at Umbilico, you agree that you are undertaking a form of exercise which has inherent risk of injury. You agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Umbilico or its members for any personal injury or property damage/loss, whether caused by negligence or otherwise.

A waiver/par Q form must be completed prior to your first attendance to any activity, class or workshop at Umbilico, by completing and signing this form you are agreeing to Umbilico’s conditions of entry and term agreement.

All purchases are final. Umbilico does not offer refunds on services or products for change of mind, user error, or any other reason. In the instance of, injury, illness, change of address Umbilico reserves the right to review each case and will request official supporting documentation (e.g. a medical certificate)

Passes and memberships are non-transferable.

Passes and memberships may not be shared.

You can cancel or reschedule a class via your online account up to 12 hours before your scheduled class time. If you do not attend a booked session or cancel within the cancellation window, it will be considered a “no show” or “late cancel” respectively and you will incur a cancellation fee of 100%, forfeiting that session.

Please note that cancellation periods vary for workshops and courses. Please refer to these conditions as noted with all workshop and/or course information.

If you are unable to attend a booked class, please cancel so that your place may be made available to others.

We reserve the right to increase fees for classes, passes or memberships at any time.

Every possible effort is made to deliver classes and services as advertised. However, the schedule is subject to change as is instructor change/substitution.

Umbilico reserves the right to change or cancel a class, workshop or course up to and including the date of the class, workshop or course if insufficient bookings have been received. In the event of a class, workshop or course being altered or cancelled every effort will be made to avoid inconvenience by offering an alternative class, workshop or course or to offer you participation in the advertised class, workshop or course with an altered format.

Umbilico may take photos and/or filming at any classes. This footage may then be used for marketing and social media purposes as well as the production of online materials. Please advise us if you do not wish to have your image used for these purposes.

WEEKLY MEMBERSHIP

Service

  • Every possible effort is made to deliver classes and services as advertised, however the schedule is subject to change as is instructor change/substitution.
  • Your membership Includes the services and discounts listed below. Any additional services will incur full cost. Mindbody can incorrectly assign payment for a class not included within your membership entitlements. If this occurs, Umbilico will contact you via email to advise you, prior to debiting any money owed from your account.

Your membership allows you to attend the following at Umbilico, dependant on service category purchased:

  • (Circus Essentials) allows you to attend 1 Circus Aerials class, 1 Yoga Class and 2 Open Training sessions each week at Umbilico.
  • (Circus Plus) allows you to attend 2 Aerials, or 2 Circus Floor, or 1 Aerials and 1 Circus Floor class ,Unlimited Yoga Classes & Unlimited Open Training sessions each week at Umbilico.
  • (Circus Floor) allows you to attend 1 Circus Floor class, 1 yoga class and 1 Open Training session each week at Umbilico.

Your membership also entitles you to the following discounts on other Umbilico services:

  • a 10% discount on single session passes with The Movement Academy & UrbanGymnast
  • a 10% discount on single session Yoga and Strength Lab passes
  • a 10% discount on additional adult aerial and circus floor single session passes

Cancellation

  • The Minimum term for the membership is eight weeks. After the Initial eight weeks, your membership will continue to debit on a weekly basis.
  • After serving the initial 8-week term you can cancel your membership at any time. Five days’ notice is required to cancel your membership via email to enquiries@umbilico.com.au
  • Umbilico reserves the right to terminate memberships without a notice period, if you commit a serious or repeated breach of terms or house rules.
  • If you cancel your Umbilico membership, you will not be eligible to re-join on a new membership for a period of 4 weeks.

Participation

  • You will have between Monday to Sunday to use your weekly allocated classes.
  • If you do not participate in the class/classes or Open Training allocated to your membership within the designated week it will be forfeited. Sessions cannot be carried over to the following or another week.
  • If you cannot make your preferred class that week you are welcome to sign up for a different aerial or circus floor class on the timetable within the period of your week’s membership. Please ensure this is a class that caters for your level of experience.
  • Umbilico operates on a strict student to instructor ratio, booking is compulsory to avoid disappointment. Bookings can be made online up to 30mins prior to scheduled class and are the responsibility of the member. You can contact us if you miss the online window to check on availability.
  • You can cancel or reschedule a class via your online account up to 12 hours before your scheduled class time. If you do not attend a booked session or cancel within the cancellation window, it will be considered a “no show” or “late cancel” this will incur loss of class, make up classes will not be allowed (Except under circumstances deemed by Umbilico, to be assessed on a case by case basis).
  • If you are unable to attend a booked class, please cancel so that your place may be made available to others.
  • No transfers, suspensions or extensions are offered on unused portions of your membership due to user error, change of mind or any other reason. In the instance of, injury, illness or change of address Umbilico reserves the right to review each case and may request official supporting documentation (e.g. a medical certificate). Exceptions to will be made at Umbilico’s discretion.
  • Memberships may not be shared.

Suspension

  • You can suspend your membership for a maximum of 6 weeks in the calendar year, with the minimum suspension being 2 weeks. Suspension will run on a full week basis, as all memberships run Monday to Sunday. For example: if you are going away on a Wednesday, you will have the option of suspending from the Monday prior to, or the Monday after your departure. Please note, that if you have attended any classes in the week prior to your departure, it will be suspended from the following Monday.
  • Upon resuming your membership, you will need to serve a new 4-week minimum term before being able to suspend again or cancel your membership.

Payment

  • Payments occur on a weekly basis, every Monday. Please ensure that you have the correct amount in your account for payment.
  • Membership fees will be charged to your credit card or bank account once per week via our third party biller, Ezidebit.
  • The terms and conditions of our third-party biller form a binding component of your membership agreement. They can be found HERE.
  • Membership payments must be made upfront prior to training. We reserve the right to suspend your access to our classes until your payments are up to date.

FLEXI 10 PASSES

The ’Flexi 10 Pass’ allows you to attend 10 classes in the respective service area purchased (Aerials, Circus Floor, Young Peoples Circus, Open Training, Yoga and Strength Lab) at Umbilico.

Your Flexi 10 Pass expires 4 months after the activation of the pass. The activation date is the date of the first class booked or attended on the pass.

Umbilico operate a strict student to instructor ratio, booking is compulsory to avoid disappointment. Bookings can be made online up to 30mins prior to scheduled class and are the responsibility of the passholder. You can call us if you miss the online window to check on availability.

Classes can be block booked in advance and the onus is on pass holders to book their own classes.

You can cancel or reschedule a class via your online account up to 12 hours before your scheduled class time. If you do not attend a booked session or cancel within the cancellation window, it will be considered a “no show” or “late cancel” this will incur loss of class. Make up classes will not be allowed (except under circumstances deemed by Umbilico, to be assessed on a case by case basis).

SINGLE SESSIONS

A “Single Session” allows you to attend 1 class in the respective service area purchased (Aerials, Circus Floor, Young Peoples Circus, Open Training, Yoga and Strength Lab) at Umbilico.

If not used immediately the single session is set to expire 1 month from the purchase date.

Umbilico operate a strict student to instructor ratio, booking is compulsory to avoid disappointment. Bookings can be made online up to 30mins prior to scheduled class and are the responsibility of the passholder. You can call us if you miss the online window to check on availability.

The onus is on pass holders to book their classes.

YOUNG PEOPLE TERMS

Cancellations

Any enrolments not paid for in full by their due date will result in the participant losing their place in the term. If any classes were attended, you will incur a fee based on our drop-in rate per attended class.

Once the term has commenced, any cancellation will incur a 100% cancellation fee. Exceptions will be made for long term injury or illness upon sighting a medical certificate. The term will be credited or refunded, depending on circumstances and at Umbilico’s discretion.

Umbilico reserves the right to cancel a term if minimum numbers are not met. In this instance we will do our best to arrange an alternate option for your child, otherwise offer a credit or refund.

Umbilico reserves the right to substitute an instructor where the scheduled instructor is not available to teach.

Missed Classes

We allow one make-up class per term, provided we are given a minimum of 12 hours notice of cancellation. The make-up session can only be attended during the term period at one of our Saturday drop-in classes or our holiday classes that will run between terms. You will need to advise staff of your class of choice ahead of time so we can allocate a place. No refunds are possible if you cannot attend any of the alternate sessions.
